Probate Estates
Probate refers to administering the property of a decedent by a Personal Representative under the jurisdiction of one of Michigan’s county probate courts. Generally speaking, when a person dies leaving property in his or her own name or having rights to receive property, the assets must be administered by the probate court. The Personal Representative has numerous duties and responsibilities to the court as well as to the beneficiaries of the estate. The advice of a qualified attorney is advantageous to guide the Personal Representative in the administration of the estate properly and in accordance with various state laws.
Trust Administration
Trust administration generally happens outside of the court, which is one reason it's so appealing to clients. It's private and less costly than probating an estate in court. Per the terms of the Trust, the Trustee reports to the beneficiaries, and holds and distributes the trust assets to the beneficiaries.
